Piscatours Terms & Conditions
1. Agency Status and Limitation of Liability
Piscatours LLC acts solely as a booking agent for the third-party suppliers, lodges, charters, and transportation companies providing your trip components. We do not own, manage, or operate any fishing lodges, vessels, or ground transportation. You agree that Piscatours LLC is not liable for any injury, financial loss, property damage, delay, or irregularity caused by the acts, omissions, or bankruptcy of any third-party supplier.

2. Passports, Visas, and Entry Requirements
Travelers are strictly responsible for obtaining and maintaining valid passports (valid for at least 6 months past return date), visas, entry permits, and health vaccinations required by the destination country. Piscatours LLC is not responsible if you are denied entry into a country or boarding onto a transit vessel due to improper documentation. No refunds will be issued under these circumstances.

3. Cancellation, Refunds, and Weather Disruption
All deposits and payments are strictly non-refundable by Piscatours LLC, and any potential refunds or credits are subject entirely to the operating supplier's local lodge policies. Fishing trips are highly dependent on weather, river conditions, and environmental factors. Piscatours LLC does not guarantee specific weather or fishing outcomes. If a lodge or charter cancels a trip due to unsafe weather or mechanical failure, refunds or credits are subject strictly to the operating supplier's local policy. We highly recommend purchasing comprehensive trip cancellation insurance.

4. Accuracy of Booking Details
You must ensure that the names provided during checkout match your passport exactly. Any fees, penalties, or ticket re-issuance costs resulting from incorrect name submissions or booking details provided by the user will be the sole financial responsibility of the traveler.

5. Currency Conversion and Exchange Fluctuations
All prices displayed on our website are subject to real-time currency conversions. The final amount charged will be processed in the selected currency at the current exchange rate provided by our payment processors Wise/Mercury. Piscatours LLC is not responsible for any foreign transaction fees, cross-border fees, or differences in final pricing caused by currency fluctuations between the time of booking and the time the payment settles.

6. Bank Transfer Disputes and Resolution
You explicitly agree that cancellations due to weather, travel delays, local regulatory changes, or destination dissatisfaction do not constitute valid grounds for a refund or payment dispute. Any financial disagreements must be handled directly through our customer service department in accordance with our stated cancellation policy.

7. Local Destination Taxes and Environmental Fees
Your payment covers the specific lodging and guiding package detailed in your confirmation emails and invoice. Some international jurisdictions impose mandatory local tourist taxes, eco-fees, conservation licenses, or marine park entry fees that must be paid in person in local cash. Piscatours LLC is not liable for these localized fees unless explicitly stated in your booking itinerary.

8. International Airfare Exclusion and Independent Travel Logistics
Piscatours LLC strictly handles lodging, local transport in country and guiding arrangements. We do not book, manage, or provide flight insurance for international air travel. You are entirely responsible for booking your own international flights and ensuring you arrive at the designated lodge pickup location on time.
Piscatours LLC is not liable for any financial losses, missed lodge days, or shortened trip durations resulting from international flight delays, international airline cancellations, or lost baggage.

8a. Domestic Flights and Regional Air Carriers
All regional, charter, and domestic flights included in your package itinerary are operated independently by local third-party air carriers. Piscatours LLC acts solely as a booking intermediary for these flights and does not own, pilot, maintain, or operate any aircraft.
You agree that Piscatours LLC is not responsible or liable for any flight delays, cancellations, mechanical failures, airline bankruptcies, schedule changes, or lost/damaged baggage.
Because remote regional flights in Central and South America are highly dependent on localized weather conditions, any itinerary alterations, missed lodge days, or additional hotel/meal costs resulting from domestic flight disruptions are the sole financial responsibility of the traveler. Piscatours LLC will not issue refunds or credits for portions of the trip missed due to regional airline disruptions.

9. Payment via Bank Transfer and Processing Fees
All payments must be made via direct bank wire, ACH, or local bank transfer to the accounts specified on your invoice. The traveler is strictly responsible for all intermediary bank fees, sending fees, and incoming wire charges. Piscatours LLC must receive the exact net amount stated on your invoice. If bank fees result in a short-payment, the remaining balance will be added to your final invoice and must be settled before trip departure.

10. Booking Confirmation and Funds Clearance
A booking is not legally confirmed, and lodge spots are not secured, until funds have fully cleared and settled into the Piscatours LLC business bank account. Piscatours LLC is not liable if a lodge fills a slot because your bank transfer was delayed, held for compliance review, or sent incorrectly.

11. Mechanism for Approved Refunds
In the rare event that a refund is authorized under the local lodge’s specific policies, the refund will be issued exclusively via bank transfer to the sender's account of origin. Piscatours LLC will deduct all applicable international wire transfer fees and currency conversion costs from the final refund amount. We do not issue cash, check, or credit card refunds.

12. Remote Infrastructure, Local Disruptions, and Force Majeure
Many fishing destinations in Central and South America are highly remote. Piscatours LLC is not liable for trip disruptions, delays, or cancellations caused by local political unrest, strikes, border closures, changes to national park or marine license regulations, road blockages, extreme weather, or mechanical failures of local bush planes and water taxis. No refunds will be issued for missed itinerary days due to these external factors.

13. Mandatory Medical Evacuation Insurance Waiver
Due to the remote nature of fishing lodges in Central and South America, access to advanced medical facilities may be delayed by hours or days. By initiating a bank transfer, you acknowledge that you are required to purchase independent medical evacuation insurance (e.g., Global Rescue or Medjet). Piscatours LLC accepts zero liability for medical costs, emergency transportation logistics, or personal injury sustained during transit or at the lodge.

14. Payment Schedule & Cancellation Terms
-
Initial Deposit: 50% of the total trip cost is due within 5 business days of invoice issuance to secure your booking slot. Deposits are strictly non-refundable.
-
Final Balance: The remaining 50% balance is due exactly 60 days prior to the trip departure date.
-
Late Payment & Forfeiture: If the final balance is not received in full by the 60-day deadline, Piscatours LLC reserves the right to treat the booking as canceled by the traveler. In this event, your 50% deposit and your spot at the lodge will be permanently forfeited.
-
Late Bookings: For any bookings made less than 60 days prior to trip departure, 100% of the trip cost is due immediately via bank transfer.

15. Agency, Referral, and Commission Disclosure
Piscatours LLC operates as an independent travel agent and booking referral service for fishing lodges and guides throughout Central and South America. Please be advised that we receive financial commissions, referral fees, or incentives from third-party lodges and suppliers for bookings made through our services. This commission structure does not impose any additional costs on the traveler.
16. Cancellation by Traveler and Refund Schedule
All cancellations must be submitted to Piscatours LLC in writing via email from the address associated with the booking. The date the email is received determines the cancellation timeline and applicable fees. Because deposits and payments are immediately used to secure non-refundable lodge slots and domestic flight tickets, refunds are strictly governed by the following schedule:
-
More than 90 days before departure: The initial 50% deposit is non-refundable. If any additional payments were made ahead of schedule, they will be returned minus a $150 administrative cancellation fee.
-
60 to 90 days before departure: The initial 50% deposit is completely forfeited. Any additional funds paid toward the final balance will be refunded.
-
Fewer than 60 days before departure: 100% of the total trip cost (including the deposit, final balance, and domestic flights) is strictly non-refundable. No cash refunds, partial credits, or date transfers will be issued under any circumstances.

17. Late Arrivals, No-Shows, and Unused Services
No refunds, credits, or adjustments will be made for any unused portions of the trip itinerary, missed lodge days, skipped guided fishing sessions, or missed domestic flights due to traveler delays, illness, or personal reasons. If you arrive late to the destination, you are entirely responsible for all additional expenses incurred to catch up with the itinerary or transfer to the lodge.

18. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming where Piscatours LLC is incorporated. Any legal actions, claims, or proceedings arising out of your booking must be filed exclusively in the state or federal courts located in that state.

19. Assumption of Risk and Personal Injury Release
Guided fishing and international travel involve inherent risks, including remote locations, wild animals, unpredictable waters, and varying levels of medical access. By finalizing your payment, you voluntarily assume all risks associated with this travel. You explicitly release Piscatours LLC from any and all liability for personal injury, illness, emotional distress, or death occurring during transit, on the water, or at the lodge facility.

20. Acceptance through Payment
While an electronic or physical signature is required to confirm bookings, the initiation of a bank transfer, ACH, or wire payment to Piscatours LLC constitutes complete, unconditional acceptance of these Terms and Conditions by the traveler, even in the absence of a signed document.
